Draft, pending counsel review. This text is a working draft and is not yet legal advice or a final agreement.

1. Who we are

These terms are an agreement between you and Nexbitra, which operates Nexbitra. "We" means Nexbitra; "you" means the person who opens the account.

2. What you buy

You buy an evaluation service: a simulated trading account, the rules it is evaluated under, the trading terminal, the dashboard and, if you pass, a simulated funded account. Every account is simulated, including funded accounts. Account sizes are virtual and are not capital provided to you. No order you place is sent to an exchange, and we do not accept, hold or manage your funds. The fee is a payment for the service, not a deposit or an investment.

3. Who may use the service

You must be 18 or older and must not live in a restricted country. The list is shown at the bottom of every page and may change on legal advice. You may hold several accounts, but only under your own name and identity. You must give true information at signup, at checkout and during identity verification.

4. Rules

Each account is evaluated under the ruleset published for its product at the moment of purchase. The ruleset is shown on the rules page and stored with your account. We never change the rules of an existing account against you. We may apply a change in your favour to existing accounts, and we tell you when we do.

A breach of a loss limit ends the account automatically. A breach evaluated while a market data source was unreliable is reviewed by a person before it becomes final.

5. Prohibited strategies

Hedging across accounts, copy trading between people, latency arbitrage, using several identities and abusing the daily reset are prohibited. The rules page defines each one. Automated checks only flag trades; a person reviews every flag. A confirmed violation may lead to a warning, the exclusion of the flagged trades from a reward, or the rejection of a reward and the closure of the account. We tell you the outcome and the rule it rests on.

6. Funded accounts and rewards

If you pass, you verify your identity, pass sanctions screening and sign the trader agreement before a funded account is issued. Rewards on a funded account are performance rewards paid under the trader agreement. They are not wages, salary, employment income or investment returns, and no reward or income is promised. You are responsible for your own taxes.

7. Fees and refunds

Fees are shown before you pay and are paid in bitcoin. The refund policy applies: a full refund until your first trade on the account, and none after it.

8. Ending the service

You may stop using the service at any time. We may close an account that breaks these terms, after the review described in section 5. Purchase, payment and reward records are kept for the period the law requires, even after an account is closed.

9. No advice

Nothing in the service is investment, legal or tax advice, or an offer to buy or sell any asset.

10. Governing law

The governing law and the venue for disputes are set with counsel before launch. Until then this document is a draft and does not bind either party.
